| Abstrakt: | Tato diplomová práce se věnuje problematice whistleblowingu a ochraně oznamovatelů. Whistleblowing je proces oznamování nekalého, neetického, protispolečenského jednání poškozující veřejný zájem. Důraz je kladen především na seznámení čtenáře se základními pojmy, historií a významem pro lepší pochopení celkového kontextu. Ačkoli tento pojem pochází z přelomu 60. a 70. let 20. století, v ČR se zatím stále jedná o kontroverzní téma. Práce se snaží o pochopení současného vnímání dané problematiky veřejností v ČR. Prostřednictvím analýzy současného právního stavu na ochranu oznamovatelů v ČR, práce upozorňuje na neuspokojivý stav. Pro úplnost této analýzy je jedna kapitola věnována analýze právní úpravy na ochranu oznamovatelů v zahraničí, konkrétně ve Spojených státech, Velké Británii a na Slovenku, která umožní srovnání uvedených právních stavů. Zároveň se tato práce věnuje nejnovějšímu legislativnímu počinu, v podobě nově přijaté směrnice na ochranu osob oznamujících porušení práva Unie, která poukazuje na relevantnost tématu a předesílá nový směr v celkovém pojetí probírané problematiky na našem území. Na závěr jsou uvedeny úvahy nad možným lepším uchycením whistleblowingu v ČR. |

| Abstrakt: | This diploma thesis deals with the issue of whistleblowing and whistleblower protection. Whistleblowing is the process of reporting unfair, unethical, anti-social behavior harming the public interest. Emphasis is placed primarily on acquainting the reader with the basic concepts, history and importance for a better understanding of the overall context. Although this term comes from the turn of the 60s and 70s of the 20th century, it is still a controversial topic in the Czech Republic. The work tries to understand the current perception of the issue by the public in the Czech Republic. Through the analysis of the current legal status for the protection of whistleblowers in the Czech Republic, the work draws attention to the unsatisfactory situation. For the completeness of this analysis, one chapter is devoted to the analysis of the legislation on the protection of whistleblowers abroad, specifically in the United States, Great Britain and Slovakia, which will allow a comparison of these legal situations. At the same time, this work deals with the latest legislative work, in the form of a newly adopted directive on the protection of whistleblowers, which points to the relevance of the topic and presents a new direction in the overall concept of the issue in our territory. Finally, there are considerations about a possible better fit of whistleblowing in the Czech Republic. |
