We believe, however, that the Insolvency Act fails in resolving of a conflict between an owner-manager and (in particular) financial creditors which is quite common in distressed companies in the Czech Republic and Slovakia. Bearing this in mind, this article puts emphasis on the fact that tools used for restructuring processes in Germany (trust management - doppelnützige Treuhand and feasibility assessment - Sanierungskonzept) represent big solution potential in relation to this kind of conflict also in the Czech institutional environment. The article introduces said institutes and also suggests the way of their implementation into the Czech system of law. The first part of the article deals mainly with the importance of surveys in general and by the importance of collecting data on insolvency proceedings. Further, the article briefly informs about the history of the insolvency investigation and shows the different parts of the questionnaire. In conclusion, the article introduces further options, which are offered by the questionnaire and by the survey. Particularly in case that this system would be introduced as a standardized tool of the insolvency proceedings and also systematically incorporated by the insolvency courts as one of the databases of the Ministry of Justice of the Czech Republic. The work also suggests necessary legislative changes which need to be done before the questionnaire will be fully integrated by the government. This is the third in a wave of similar surveys, while the present work the analysis results are compared with just these previous data sets. Together, there were processed 2193 closed insolvency proceedings. These proceedings represent nearly 20 percent of the total number of insolvencies of businesses operating in the country during that period took place and have already been completed. This sample should therefore be very representative, on the other hand, the authors do not conceal that the results are still only approximate. The key findings of the research as usual satisfaction of secured creditors, unsecured creditors, satisfy claims against the estate of a debt assimilated claims against the estate of length insolvency proceedings and more. The article focuses on evaluation of the default risk coming from engineering companies. Based on sample of 2012 engineering companies, the results show that payment habits increase with higher return on assets, higher liquidity, lower debt ratio and higher liability turnover. Payment habits of engineering companies are very good. However, about 6 % of solvent companies have poor payments habits. Such companies are risky for their suppliers with respect to the secondary insolvency phenomenon. The case study demonstrates the growing importance of intangible assets. By using the VIM model, brand valuation as identifiable intangible asset is condcuted by valuing the business enterprise for transactional purposes.
