Technické překážky obchodu v regulaci Evropské unie

Technická regulace patří k prostředkům se silným vlivem na mezinárodní obchodní toky. Jedná se o autonomně implementované překážky obchodu, které se s postupující liberalizací mezinárodního obchodu stávají nejvíce užívanými netarifními opatřeními na ochranu domácích trhů. Technická regulace má jak pozitivní, tak negativní dopady na podnikatele a spotřebitele a zahrnuje řadu dilemat. Problém technické regulace dále spočívá v komplexnosti systému technických standardů a norem, který není závazně mezinárodně upraven. K překonání těchto negativ slouží mezinárodní harmonizace technických standardů nebo vzájemné uznávání shody. Technická regulace má také potenciál stát se překážkou volného pohybu zboží - proto se článek zabývá způsobem řešení tohoto problému v Evropské unii včetně institucionálního ukotvení a návaznost na národní legislativy členských států.

Technical Barriers to Trade in the EU Regulation

Technical regulation belongs to means with a strong influence on international trade flows. The regulation is a barrier to trade that is autonomously implemented by governments and becomes the most used non-tariff barrier for protection of domestic markets. Technical regulation has both positive and negative effects on entrepreneurs and consumers. The problem lies in complexity of the system of technical standards and norms that is not internationally regulated in a binding manner. In order to overcome these negatives, governments and nongovernmental organizations and subjects cooperate on harmonization of technical standards or are proceeding through recognition of complementarity of standards. Technical regulation has a potential to become a barrier to free movement of goods - it is why the article deals with the mentioned problem in the European Union including institutions and relation to the national legislation of Member States.
