HORIZONTÁLNÍ SOCIÁLNÍ KLAUZULE ČL. 9 SFEU - MRTVÉ USTANOVENÍ NEBO ZÁKLAD SOCIÁLNĚ-EKONOMICKÉ ROVNOVÁHY EU?

Tzv. horizontální sociální klauzule, obsažená v čl. 9 Smlouvy o fungování EU, zavazuje orgány EU již od prosince 2009 k tomu, aby ve své veškeré činnosti zohlednily určité sociální zásady. Ačkoli byl tomuto novému smluvnímu ustanovení připisován před sedmi lety značný potenciál, při pohledu na post-lisabonský vývoj EU, dokumenty Komise i rozhodnutí Soudního dvora, je jasné, že horizontální sociální klauzule EU nijak nezměnila. EU přitom trpí stále stejným "sociálním deficitem", za který byla evropskou levicí i odbory kritizována již v před-lisabonském období a který ji připravuje o podporu občanů EU. Pozitivní efekt horizontální sociální klauzule na politiky EU by tudíž vyžadoval její zesilující doplnění, např. tak, jak je v textu studie navrženo.

HORIZONTAL SOCIAL CLAUSE OF ART. 9 TFEU - A DEAD PROVISION OR A BASE OF THE EU SOCIO-ECONOMIC BALANCE?

The so-called horizontal social clause contained in Art. 9 of the Treaty on the Functioning of the EU obliges EU, already since December 2009, to ensure that in all its activities certain social principles are reflected. Although seven years ago a significant potential this was attributed to this new Treaty provision, looking back at the post-Lisbon EU developments, Commission´s documents and decisions of the EU Court of Justice, it is clear that the horizontal social clause has not changed the EU at all. The EU is still suffering from the same "social deficit" for which the European left and the unions has been criticizing it in the pre-Lisbon period and which is depriving it of the support of EU citizens. The positive effect of the horizontal social clause on EU policies would therefore require a boosting supplement, e. g. as the one suggested on in the text of this study.
